2. The petitioner has preferred this application for grant of regular bail in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 318 of 2023 dated 27.07.2023 registered for the offence punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)a, 26, 25(b) and 35 of the Arms Act.

3. As per the prosecution case, one country made loaded Katta was alleged to have recovered from the possession of the petitioner when the petitioner and other co-accused persons were assembled for making preparation to commit crime.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that as a matter of fact, nothing has been recovered from the possession of the petitioner and the petitioner was arrested in the night of 26.07.2023 from his house and later on he was implicated in the present case. The petitioner has two criminal antecedent and in both the cases the petitioner has been granted bail, as stated in paragraph no. 3 of the bail petition. He is in custody in this case since 27.07.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Buxar, in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 318 of 2023.

7. The application stands allowed.
