JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-05-2017 Heard learned Counsel for the petitioner and the learned Additional Public Prosecutor representing the State.

By the impugned order, dated 22.12.2016, passed in Maintenance Case No. 06 of 2008, learned Principal Judge, Family Court, Lakhisarai, has allowed the petitioner to pay the arrears of maintenance allowance in seven monthly instalments.

Learned Counsel for the petitioner has submitted that the petitioner is not in a position to make payment in seven instalments.

On perusal of the impugned order, I find that the learned Court below fixed payment of arrears in

Patna High Court CR. REV. No.121 of 2017 (3) dt.18-05-2017 2/2 instalments since the petitioner had failed to pay monthly maintenance allowance despite order of the Court. I do not find any reason to interfere with the order impugned.

Learned Counsel for the petitioner has submitted that the said maintenance allowance was granted in favour of the son of the petitioner also, who has, now, become major.

It goes without saying that the petitioner shall have liberty to approach the learned Court below in that regard. This Court is not required to make any comment on that.

This application stands disposed of.
