Heard learned counsel appearing on behalf of the State and learned counsel appearing on behalf of the Accountant General, Bihar, Patna.
The prayer of the petitioner in the present application is to issue a direction to the respondents to revise pay of the petitioner in the scale of 5,500-9000/- with effect from 1.1.1996 payable from 1.4.1997 and to pay difference of salary and to revise pension and gratuity.
Learned counsel for the Accountant General has submitted that the Commandant, BMP-2, Dehri, Rohtas vide his letter no.4700 dated 6.12.2006 sent the pension case and service book of the petitioner fixing the pay in the scale of Rs.5,0009000/- under ACP scheme and accordingly revised the pension
Patna High Court CWJC No.13325 of 2007 (2) dt.21-01-2015 2/2 and gratuity and authority vide no.Pen-6-5379-84 dated 16.1.2007 has been issued by the Accountant General.
Learned counsel for the State has submitted that Commandant BMP-2 Dehri, Rohtas has already allowed ACP to the petitioner in the scale of Rs.5,500-9000/-. In view of the submissions made at the Bar by the learned counsel for the State and learned counsel for the Accountant General, Bihar, Patna, I am of the view that no useful purpose will be served by keeping the matter pending as the grievance of the petitioner has already been redressed.
