ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 03.08.2019 in connection with Sadar Circle Excise P.S. Case No. 35 of 2019 registered for the offence under Sections 30(a), 53 and 56 of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that though the alleged recoveries were made from a red colour car, which was caught after chasing. So far as the petitioner is concerned he has nothing to do with the red colour car and only because he was travelling in the same, the petitioner has been taken into custody. In view of the aforementioned facts and circumstances, and nothing has been recovered from the conscious possession of the petitioner and that, save and except, one other case, the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Additional District and Sessions Judge-cum-Special Judge of Excise, Araria in connection with Sadar Circle Excise P.S. Case No. 35 of 2019.
