JUSTICE RAJENDRA KUMAR MISHRA ORAL JUDGMENT Date: 11-09-2017 ------------- This application, under Section 482 of the Code of Criminal Procedure, has been filed on behalf of the petitioner to quash the F.I.R. of Garhpura P.S. Case No.4 of 2011 registered under Sections 467, 468, 420 and 120-B of the Indian Penal Code against 12 persons, named in the F.I.R., including the petitioner.
2. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
3. Learned counsel for the petitioner submits that while Garhpura P.S. Case No.4 of 2011 was instituted against 12 persons, including the petitioner in the year 2011 but still chargesheet has not been submitted by the police after investigation.
4. Learned A.P.P. for the State submits that after
Patna High Court Cr.Misc. No.50817 of 2013 dt.11-09-2017 2/2 investigation, the police has submitted chargesheet No.45 of 2016 dated 31.05.2016 in Garhpura P.S. Case No.4 of 2011.
5. Since chargesheet has already been submitted by the police in Garhpura P.S. Case No.4 of 2011, after investigation, I find no reason to quash the F.I.R. of Garhpura P.S. Case No.4 of 2011.
