Mr. Ashok Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-12-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bahadurpur P.S. Case No. 110 of 2017 for the offenses punishable under Section 30(a) of the Bihar Excise Prohibition Act, 2016.

The allegation is regarding recovery of 240 liters of illicit liquor from a Pick-Up van and when the co-accused persons were arrested, they are said to have named the petitioner as their accomplice.

The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. As far as criminal antecedent is concerned, the petitioner is stated to be an accused in three other cases,

Patna High Court Cr.Misc. No.72848 of 2018(3) dt.14-12-2018 2/2 however, he is on bail in the said three cases and he is languishing in custody since 04.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV-cumSpecial Judge, Darbhanga in connection with Bahadurpur P.S. Case No. 110 of 2017.
