JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-01-2019 Perused the defect pointed out by the stamp reporter. It has been submitted by learned counsel for the petitioner that in view of the resolution of Advocate's Association, he has withdrawn the application and, thereafter, no advocate is appearing on behalf of the petitioner in the court below, as such, he could not file the fresh application for anticipatory bail before the court below.
Learned counsel for the informant is present in the court and he has submitted that submission of learned counsel for the petitioner is not true and as a matter of fact he himself is not filing any application before the court below and it is not the fact that no advocate is ready to appear on behalf of the petitioner.
In such view of the matter, this application is
Patna High Court Cr.Misc. No.589 of 2019(2) dt.17-01-2019 2/2 permitted to be withdrawn with liberty to petitioner to move before the court of Sessions Judge for filing fresh application for anticipatory bail and the learned Sessions Judge will hear the same and will pass an appropriate order on merit. Accordingly, this application is dismissed as withdrawn.
