Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.
Isuapur P.S.Case No.39 of 2018 was registered for kidnapping of a minor girl. The police has submitted chargesheet in the case without recovery of the victim or coming to the conclusion that this was not a case of kidnapping. Petitioner is in custody since 09.08.2018.
Considering the aforesaid facts and in absence of substantial material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like
Patna High Court CR. MISC. No.77453 of 2018(4) dt.12-04-2019 2/2 amount each to the satisfaction of learned Court below where the case is pending in connection with Isuapur Police Station Case No.39 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. Let the Superintendent of Police, Saran enquire into the conduct of the Investigating Officer in concluding the investigation without recovery of the victim girl or without recording any finding that the offences alleged are false and frivolous.
The enquiry report must come within eight weeks.
Let a copy of this order be sent to the Superintendent of Police, Saran also.
