The petitioner seeks bail in a case registered under section 394 of the Indian Penal Code and later on sections 395 and 412 I.P.C. were also added.

The petitioner is not named in the first information report. The name of the petitioner figured in the case in the confessional statement of Rabindra Sahni and from his possession looted motorcycle was recovered. The petitioner was apprehended and thereafter police obtained his confessional statement. The police did not put the petitioner on T.I.P. Except the confessional statement the police did not collect tangible evidence against the petitioner although he is in jail since 20.10.2014.

Considering the aforesaid facts, the above

Patna High Court Cr.Misc. No.5749 of 2015 (2) dt.11-02-2015 2/2 named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of A.C.J.M, Rosera in Samastipur district in Rosera P.S.
