JUSTICE SANJAY PRIYA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Falka P.S. Case No. 154 of 2016 instituted for the offence under sections 147, 148, 149, 341, 323, 324, 504 of the Indian Penal Code. It has been submitted on behalf of the petitioner that from Annexure-3 and 4, there is bonafide land dispute between both the parties. The injury sustained by son of the informant is simple in nature. There is allegation in the written report that this petitioner injured the son of the informant with Arrow. In the injury report (Annexure-2) the doctor has found injury to be simple in nature.

It is mentioned in para-3 that petitioner has no criminal antecedent

Patna High Court Cr.Misc. No.10097 of 2017 (2) dt.09-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Falka P.S. Case No. 154 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Katihar, subject to the conditions as laid down under Section 438(2) Cr.P.C.
