1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Kanti P.S. Case No. 584 of 2023 registered under Sections 30(a), 32(i)(ii), 36 and 41(i)(ii) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that petitioner is neither owner nor driver of the seized pick up vehicle.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the concerned Court

Patna High Court CR. MISC. No.63296 of 2023(2) dt.16-10-2023 2/2 within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge, Excise Court No.II, Muzaffarpur in connection with Kanti P.S. Case No. 584 of 2023, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
