The petitioners seek bail in a case registered under Sections 341, 147, 148, 149, 302, 120(B) of the Indian Penal Code.

Allegation is that the accused persons made indiscriminate firing from their pistol upon the informant's son, as a result of which he died.

It has been submitted on behalf of the petitioners that the petitioner No.1 is in custody since 4.5.2019 and petitioner No.2 is in custody since 31.05.2019 and the petitioners have got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.57279 of 2019(2) dt.23-10-2019 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioners. The main allegation of assault is against co-accused Chandan Kumar, Lal Paswan and Dinesh Paswan, who are alleged to have fired upon the deceased. The petitioners are members of unlawful assembly.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Kishanpur P.S. case No.87 of 2019 corresponding to G.R. No.817 of 2019.
