JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kasim Bazar P.S. Case No. 100 of 2019, registered for the offences punishable under Sections 109, 115, 120(B), 386/34 of the Indian Penal Code and Section 25(1-b)A, 26/35 of the Arms Act.

On secrete information police has taken phone calls of Pawan Mandal who was lodging in Beur Jail. It further appears that police apprehended one Sonu Kumar who disclosed the name of other accused persons including the petitioner in the present case. It further appears that petitioner is accused in five other cases. It further appears from perusal of the FIR that accused Pawan Mandal has demanded Rangadari from inside the jail from one Chandan Mandal.

Submission of the learned counsel for the petitioner

Patna High Court CR. MISC. No.57367 of 2019(2) dt.11-09-2019 2/2 that except confessional statement there is nothing against the petitioner and in all other cases final form has been submitted against the petitioner.

Learned A.P.P. for the State has opposed the prayer for bail.

Having heard both sides, in view of the allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered on the basis of material available on record on its own merit without being prejudiced by this order With the aforesaid, this application is dismissed.
