The father-in-law of the victim apprehends his arrest in connection with Silao P.S. case no. 93 of 2014, registered under Sections 498A and 304B of the I.P.C. lodged by the brother of the victim alleging therein that her sister was married to the son of the petitioner six years ago. She was tortured continuously by the sasural people and was done to death in the matrimonial home by putting her on fire.
The contention of the petitioner is that he was not in the house when the alleged occurrence is said to have taken place . In fact, the marriage between the son of the petitioner and the
Patna High Court Cr.Misc. No.51871 of 2014 (4) dt.29-06-2015 2/2 victim/deceased has been performed in 2002. The informant has purposely alleged about the marriage having taken place six years ago. Some of the co-accuseds like the mother-in-law and sautan have been released on anticipatory bail by this Court. Learned counsel for the informant as well as the State, on the other hand, points out from the case diary that independent witnesses of the village have supported the prosecution case. At the dead of night the room in which the victim was living was seen burning and the victim was retrieved therefrom with serious burn injuries. Post mortem report also indicates the similar injury. Considering the seriousness of the allegation and the materials collected in course of investigation, I am not inclined to privilege the petitioner with anticipatory bail. Prayer for bail is rejected.
