The petitioners apprehends their arrest in Kamtaul P.S. Case No. 192 of 2016 instituted for the offence under sections 147, 148, 149, 341, 323, 324, 504, 506 and 307 of the Indian Penal Code.
It has been submitted that there is case and counter case between the parties and both sides sustained injuries on account of land dispute.
It has been submitted that petitioner no.1 has filed Kamtaul P.S. Case No. 191 of 2016 under sections 307 of the Indian Penal Code against the informant of the present case and
Patna High Court Cr.Misc. No.10713 of 2017 (2) dt.18-03-2017 2/2 others and as a counter blast, the instant case has been filed by the informant against petitioner no.1 and others. In the written report, the injury sustained by the persons in the instant case has been annexed as Annexure-2 series and the injuries sustained by the injured persons from the petitioners' side has been annexed as Annexure-3 series. From the injury report, annexure-2 series, it appears that all the injuries were simple in nature. From the injury reports, Annexure-3 series, it appears that the injuries have been sustained by the members of the petitioners' side also and occurrence took place between both the sides on account of land dispute. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed.
In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Kamtaul P.S. Case No. 192 of 2016,they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr.P.C.
