JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-09-2019 This is an application for grant of anticipatory bail in connection with Sikandra P. S. Case No. 114 of 2019, disclosing offences under Sections 341, 323, 447, 307, 354B, 147, 148, 149 and 506 of the Indian Penal Code.

As per F.I.R. there is allegation against the petitioners no.2 and 4 of assault by Lathi on the wife of the informant and against one Bhim Yadav is of assault by Farsa on the head of the wife of informant and so far allegation against petitioners no.1 and 3 are concerned, the people assembled to save her, they did not allow to save her.

Submission of the learned counsel for the petitioners

Patna High Court CR. MISC. No.59692 of 2019(2) dt.23-09-2019 2/2 is that there is case and counter case between the parties. There is allegation against petitioners no.2 and 4 that they assaulted the wife of the informant, though the injury appears to be grievous in nature but that has been attributed on her finger of right hand and against petitioners no.1 and 3 there is allegation of assault.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of Sri M.K. Pandey, learned Judicial Magistrate, 1st Class, Jamui, in connection with Sikandra P. S. Case No. 114 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
