JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kutumba P.S. Case No. 87 of 2016 instituted for the offence under Sections 302/34 of the Indian Penal Code.

It is alleged that the petitioner along with three unknown persons came to the house of the informant on 5.9.2016 at 11:30 p.m. and took his father but no any report was ever made before the police. On 7.9.2016, a written report was filed when the dead body of the father of the informant was found on 6.9.2016 in the village which was seen by a lady who had gone for call of nature.

From the written report it appears that mere suspicion has been raised that the petitioner along with three unknown

Patna High Court Cr.Misc. No.5480 of 2017 (3) dt.10-03-2017 2/2 persons had taken his father on 5.9.2016 and killed him. It has been submitted on behalf of the petitioner that the occurrence took place on 5.9.2016 whereas the First Information Report has been lodged on 7.9.2016 after recovery of dead body.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Kutumba P.S. Case No. 87 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Aurangabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
