JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 498A/34 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that it is stated before the court below also that he is ready to keep the complainant with dignity. He has also filed a case for restitution of conjugal life before the Principal Judge, Family Court, Khagaria.

Heard learned A.P.P. also.

Having heard both sides, in view of the submission

Patna High Court Cr.Misc. No.11779 of 2017 (2) dt.21-03-2017 2/2 made above, petitioner is directed to surrender in the court below i.e., S.D.J.M., Khagaria, in connection with Complaint Case No. 27 (C) of 2016 with an application giving undertaking regarding the submissions made above. If such an application is filed, petitioner will be allowed provisional bail by its own satisfaction the court below calling upon both the parties on the date fixed for mediation. On the date fixed, if the parties appear and agree to live together and opposite party no. 2 leaves with the petitioner to his house, then the court below will watch the conduct of both the parties for the next six months. If the court below finds the conduct of both the parties satisfactory for six months, then he will confirm the bail bond of the petitioner or pass any other order.
