2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 325 , 379 and 34 of the Indian Penal Code.
3. On the alleged date and time of occurrence all the FIR named accused persons including these petitioners assaulted the wife of the informant with iron rod and Khanti on her head , hand and back due to which she sustained injury . It is further alleged that accused persons also snatched her earring, payal and ring.
4. It is submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.63019 of 2023(2) dt.17-10-2023 2/2 present case is counter blast of Mansi PS Case No. 41 of 2023 which was lodged by co-accused Jagdish Yadav against the prosecution party . Allegation of assault is general and omnibus. No specific overt act has been alleged against these petitioners. Rest of the allegation is ornamental in nature . Petitioners claim clean antecedent.
5. Learned counsel for the State oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Khagaria in connection with Mansi P . S. Case No. 40 of 2023 P.S. Case No. of subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
