JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are parents-in-law of the deceased and admittedly, the informant has not seen the alleged occurrence rather having got information about the alleged occurrence, he came at the house of the informant and learnt about the alleged occurrence. In Para -4 of the case diary, the informant specifically stated that when he reached near the place of occurrence, the son of the deceased disclosed that it was his father, who committed the murder of his mother and so far as petitioners are concerned, the aforesaid witness disclosed before the informant that they were standing out side . Although the statement of the son of the

Patna High Court Cr.Misc. No.37651 of 2015 (5) dt.10-12-2015 2/2 deceased was recorded at para -12 of the case diary who repeated similar fact. The husband of the deceased has already remanded in the present case. .

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Naokothi P.S.Case No. 42 of 2013.
