2. The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 30(a)/41(1) of the Bihar Prohibition and Excise Act & 110/111 of B.N.S.

3. The case of the prosecution is that altogether 675 liters of raw spirit was recovered from a pickup van and godown of Om Logistics.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Learned counsel for the petitioners has submitted that nothing has been recovered from the physical possession of the

Patna High Court CR. MISC. No.65165 of 2025(2) dt.23-09-2025 2/2 petitioners and the petitioner no. 1 is Manager and petitioner no. 2 is Assistant Manager of the Om Logistics Pvt Ltd. They have no knowledge about the alleged recovery. It has also been submitted that petitioner no. 1 is having no criminal antecedent. Moreover, the petitioners are languishing in judicial custody since 28.06.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner no. 2 is having a criminal antecedent of one case.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Gopalganj Town P.S. Case No. 485 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-XIII-cum-Spl. Judge, Excise-I, Gopalganj.
