JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Jalley P.S. Case No. 89 of 2014 instituted under Sections 498A, 323, 379, 406 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the informant got her marriage with the petitioner about four years ago and she went to her sasural. Subsequently, her sasural people including her husband started torturing her due to nonfulfillment of demand of Rs.1,00,000/-and one motorcycle. It is submitted on behalf of the petitioner that the petitioner is the husband of the informant and he is ready to keep the complainant as his wife with full dignity and honour
Patna High Court Cr.Misc. No.52218 of 2014 (4) dt.08-05-2015 but in spite of his best efforts being made, informant is not ready to stay with the petitioner.
On behalf of the State and counsel for the informant, it is submitted that the informant is also ready to stay with her husband.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S. Case No. 89 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
It is further directed that if the informant and the petitioner failed in living together, then in the said circumstances, the petitioner shall deposit an amount of Rs. 1500/- per month before the learned court below, which shall be released in favour of the informant.
