JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-12-2022 Heard learned counsel for the petitioner and Mr. M. N. H. Khan, learned Standing Counsel-1 for the State. This writ application has been filed seeking the following reliefs:- "(i) For direction to the respondents to trace out the victim of Town P.S. Case No. 371 of 2016 namely Pallavi Kumari aged about 13 years and produce before the Hon'ble Court.

(ii) For direction to the Respondents to take proper investigation as per Section 2 (h) of the Criminal Procedure Code.

(iii) For direction to the Respondents to take investigation under the supervision of any

(iv) for any other reliefs/reliefs entitled the petitioner accordance with law.

It is the case of the petitioner that he has filed Town P.S. Case No. 371 of 2016 in which he has stated that her daughter ('X') left for market on 12.06.2016 at 2.30 P.M. for purchasing household articles but she did not return. The grievance of the petitioner is that despite his approaching several authorities of the State to take steps towards tracing out the daughter of the petitioner, the authorities were not acting.

At this stage, a counter affidavit has been filed on behalf of the Criminal Investigation Department (CID) sworn by the Additional Director General of Police (W.S.) CID, Bihar. The counter affidavit discloses in detail the steps taken by the CID so far after handing over of the case to them by the D.I.G. of Police (C), Criminal Investigation Department, Bihar vide letter no. 284(AHTU) dated 25.08.2021.

This Court has perused the counter affidavit. In the interest of justice it is not required to disclose every fact which is stated therein because the investigation is still going on and efforts are being made to trace the victim girl. At this stage, this writ application is being disposed of with a direction to the ADG (W.S.) to keep on supervising this

Patna High Court CR. WJC No.1592 of 2019(8) dt.06-12-2022 3/3 case every two weeks and take all such measures which are required, in tandem with the other agencies which may be involved in connection with this case and ensure that the victim girl is traced within a reasonable time.

Considering the disclosure made in the counter affidavit, this Court is of the opinion that some more time may be given to the CID to resolve this case.

Liberty will be there with the petitioner to file an appropriate application in this Court if it is found that the CID is not able to trace the victim girl and there is any inaction on the part of the CID in proceeding with the investigation with a sense of urgency.
