The petitioner is apprehending his arrest in connection with Habibpur P.S.case No.110 of 2018 registered for offences punishable under Sections 354A of the Indian Penal Code and Section 8 of the POCSO Act.
Allegation against the petitioner that is that he entered inside the house of the informant and tried forcibly to commit rape upon the minor daughter of the informant and on hulla he fled away from there.
Submission of the learned counsel for the petitioner is that there is land dispute between the parities and he has been falsely implicated in this case and the parties have compromises the case.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.77662 of 2018(2) dt.02-01-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court. With the aforesaid observation, this application is dismissed.
