JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 16.04.2014 in a case initially registered for the offences punishable under Sections 363, 365, 379 of the Indian Penal Code and later on, Sections 302, 201, 120B of the Indian Penal Code were also added. Petitioner is not named in the first information report and it appears that the looted pick up van was recovered at Dumra police station and one Birendra Kr. Rai was caught along with the aforesaid pick up van. It further appears from the impugned order that petitioner wanted to purchase the aforesaid pick up van but when deceased refused to sell the said pick up van, the petitioner had given threatening to the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX, Muzaffarpur in connection with Sessions Trial No. 687 of 2014 arising out of Minapur P.S. Case No. 373 of 2013.
