The petitioner is accused in connection with Sessions Trial No. 431 of 2021 arising out of Vaishali P.S. Case No. 88 of 2015 registered under Sections 304B and 201/34 of the I.P.C.

Submission of learned counsel for the petitioner is that earlier prayer of the petitioner for bail was rejected by this Court on 01.03.2021 passed in Cr. Misc. No. 30715 of 2020. Further he submits that petitioner is in custody since 16.06.2020.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that prayer of

Patna High Court CR. MISC. No.72102 of 2021(3) dt.16-02-2022 2/2 the petitioner for bail was rejected on merit on 01.03.2021 passed in Cr. Misc. No. 30715 of 2020. The trial is in progress. The status report as called for from the learned Court below shows that charge has been framed and summons have already been issued on prosecution witnesses and the case is fixed for evidence.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of learned counsel for the State, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is again rejected.

Trial Court is directed to conclude the trial within a period of six months.
