JUSTICE AJIT KUMAR ORAL ORDER 16-09-2025 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the Veer Kunwar Singh University (hereinafter referred to as 'University').

2. The petitioners have filed the instant writ application for directing the respondents to consider the case of the petitioners for regularization as against the post earmarked for 4th grade Employee and to make payment of enhanced remuneration in the light of Government decision, by which the

Patna High Court CWJC No.15297 of 2025(2) dt.16-09-2025 2/3 minimum remuneration has been fixed. The petitioners further prays that the respondents while considering the case for regularization would apply the ratio of the judgment passed in CWJC No.13895 of 2021 dated 16.05.2024 and as also the recent judgment of Hon'ble Supreme Court in Jaggo Vs. Union of India and others (SLP)(c) 5580 of 2024.

Learned counsel for the petitioners submits that similarly situated persons had moved before this Court vide CWJC No. 10569 of 2021, which was heard and disposed of by a coordinate Bench of this Court vide order dated 29.08.2024. In that case, the petitioners of CWJC No. 10569 of 2021 were directed to file a fresh representation before the Vice Chancellor of the University, who was obliged to dispose of the same after affording an opportunity of personal hearing to the petitioners or to their counsel representing them, by passing a reasoned and speaking order, in light of the judgment passed in CWJC No. 13895 of 2021 on 16.05.2024.

Learned counsel for the petitioners further submits that the petitioners' cases may also be directed to be considered by the Vice Chancellor of the University, strictly in accordance with the parameters adopted in the case of the petitioners in CWJC No. 10569 of 2021, whose cases have been considered

Patna High Court CWJC No.15297 of 2025(2) dt.16-09-2025 3/3 and appropriate steps are being taken for their regularization.

5. Be that as it may, let this case also be considered strictly in terms of the ratio laid down in the aforesaid case. The petitioner shall file a detailed representation before the Vice Chancellor of the University within a period of four weeks from today. Upon submission of such representation along with supporting materials, the Vice Chancellor shall pass a reasoned and speaking order strictly in accordance with law. If it is found that the case of the petitioner falls within the parameters of the case as directed to be considered in the light of the judgment rendered in CWJC No. 10569 of 2021, the petitioners' case shall also be considered by affording an opportunity of hearing, and the decision so taken shall be communicated to the petitioners. The benefits accrued shall also be extended in favour of the petitioners within a period of three months from the date of filing such representation.

6. With the aforesaid observations and directions, this writ application stands disposed of.
