28-01-2017 Heard Sri Mritunjay Prasad Singh, learned counsel for the petitioner.

The present petition has been filed with a prayer to restore C.W.J.C. No. 6444 of 1992, which stood dismissed on 28-09-1999 i.e. more than 13 years back, due to non-prosecution. Ofcourse, in the present petition, some reason has been assigned for non-appearance of learned counsel for the petitioner on the date when the case stood dismissed due to non-prosecution, neither plausible explanation has been given regarding filing of the present restoration petition after 13 years nor any limitation petition has been filed.

Patna High Court MJC No.5853 of 2013 (5) dt.28-01-2017 2/2 I do not find any ground to entertain such petition. Dismissed.
