The petitioners apprehend their arrest in connection with Jokihat P. S. Case No. 370 of 2016 instituted under Sections 341, 323, 307, 379 504 and 506/34 of the Indian Penal Code. Allegation, in brief, is that the petitioners assaulted with fists and slaps and abused the informant and Rijwan and Badud, with intention to kill him, gave iron rod blow and also assaulted by means of fist and slaps and they snatched Rs. 11000/- and one mobile phone from him.
It is submitted that there is no specific allegation of assault against the petitioners and there is case and counter case
Patna High Court Cr.Misc. No.6501 of 2017 (2) dt.10-02-2017 2/2 between both sides. The case of petitioners' side is that the informant's side was seeking extortion and in retaliation, this case was filed and informant's side have also criminal antecedent, but the petitioners have no criminal antecedent.
Having considered the aforesaid facts and circumstances of the case , let the petitioners, named above, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Amit Mannu, ACJM-II, Araria in connection with Jokihat P.S.Case No. 370 of 2016; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
