JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. The petitioner seeks pre-arrest bail in connection with Mahila P.S.Case No. 78 of 2018 registered under Sections 498A, 379/34 of the Indian Penal Code and Section 3 and 4 of the Dowry Prohibition Act.

It is submitted by the learned counsel for the petitioner that no demand of dowry was ever made by him. The FIR has been instituted on account of matrimonial discord and incompatibility.

On the other hand, learned counsel for the State being assisted by the learned counsel for the informant submitted that there is specific allegation in the FIR that the petitioner demanded Rs.1,50,000/- in cash, golden chain and a motorcycle

Patna High Court Cr.Misc. No.77465 of 2018(2) dt.11-01-2019 2/2 and for non-fulfillment of the same he has subjected the informant to cruelty.

Considering the nature of allegation and the defence taken by the petitioner as also the statement made in para 3 of the application that the petitioner has got no criminal antecedent, in the event of arrest or surrender before the court below within four weeks from today, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Ara in connection with Mahila P.S. Case No. 78 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
