2. This application is filed for modification of order dated 16.04.2024 passed in Cr. Misc. No. 26168 of 2024.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been granted bail on 16.04.2024 passed in Cr. Misc. No. 26168 of 2024 with a direction to surrender before the Court below within a period of six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Court of ADJ VIIth cum Special Judge (Excise) No. II Kaimur

Patna High Court CR. MISC. No.67767 of 2024(2) dt.12-09-2024 2/2 at Bhabhua in connection with Durgawati P.S. Case No. 427 of 2023, but due to some unavoidable circumstances, the petitioner could not surrender before the Court below within the stipulated time.

4. In view of the matter, let the time to surrender of the petitioner, as ordered on 16.04.2024 passed in Cr. Misc. No. 26168 of 2024, be further extended by four weeks from the date of receipt of this order.

5. Accordingly, the modification application is allowed and the order dated 16.04.2024 passed in Cr. Misc. No. 26168 of 2024 is modified to the above extent. (Chandra Prakash Singh, J) guddukr/- U T
