The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 22 litres of liquor was recovered from the house of the three petitioners. It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from their possession or from their house. They have been falsely implicated in the case. They are in custody since 8.11.2021 and have no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioners not having any criminal antecedent, the period in custody being 7 months and investigation in the case having concluded, all the three petitioners are directed to be enlarged on bail in connection with Maniyari P.S. Case no. 382 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
