The petitioner seeks bail in Fatuha P.S. Case No. 556/2018, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Earlier prayer for bail of the petitioner was rejected by order dated 26.11.2018 passed in Cr. Misc. No. 69636/2018 with observation that petitioner, if so advised, may file fresh bail application.

Learned counsel for the petitioner has submitted that in compliance of aforesaid observation of this Court, instant bail petition has been filed on behalf of petitioner. It is alleged in the written report that 60 litres of Mahua liquor has been recovered from the house of this

Petitioner is in custody since 19.09.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Special Judge, Excise, Patna in connection with Fatuha P.S. Case No. 556/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
