JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 379 and 411/34 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that name of the petitioner has transpired from the confessional statement of the co-accused and the alleged recovery so far as motorcycle is concerned, that is of one Suresh Kumar, who has already filed an application in the court below for release of the same.

Heard learned A.P.P. also, who has opposed the prayer for bail.

Having heard both sides and in view of the allegation

Patna High Court Cr.Misc. No.12208 of 2017 (3) dt.28-03-2017 2/2 as well as criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected. However, petitioner is directed to surrender in the court below, i.e., learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P. S. case no. 508 of 2016 and make prayer for regular bail on the basis of submission made above and the learned court below will consider the aforesaid submission and after perusal of the entire material on record will pass an appropriate order.
