====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Baikunthpur P.S. Case No. 285 of 2018 for the offenses under Sections 302, 201, 120 B/34 of the Indian Penal Code. Ms. Aishwarya Anand, Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent. The name of the petitioner has been surfaced merely on suspicion. The informant in his statement stated that he has seen the petitioner fleeing away from the place of occurrence along with one Guddu Kumar, Jaleshwar Prasad, Bhola Mahto, mother of Sima Kumari. Learned counsel for the petitioner would submit that one of the co-accused Bhola Mahto has already been granted bail by this Court in Cr.Misc. No.

Patna High Court CR. MISC. No.58627 of 2019(2) dt.30-09-2019 2/2 13702 of 2019 vide order dated 10.05.2019. The petitioner is in custody since 08.07.2019.

On account of similarity in the case of this petitioner with Bhola Mahto who has been granted bail by this Court in Cr.Misc. 13702 of 2019 vide order dated 10.05.2019, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 285 of 2018.
