2. The petitioner seeks bail in connection with Minapur P.S. Case No. 84 of 2025 registered for the offence under Sections 80 of the BNS but later charge-sheet was submitted under Section 80 and 85 of the BNS.

3. As per the prosecution case, the petitioner is accused of killing his wife.

4. The petitioner is in custody since 11.04.2025.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and the deceased has committed suicide. He further submits that two children have born out of the wedlock, who are presently staying with the family of the petitioner and the same has been mentioned in paragraph no. 15 of the bail petition.

6. Considering the aforesaid facts, this application

Patna High Court CR. MISC. No.63957 of 2025(2) dt.10-09-2025 2/2 is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-11th, Muzaffarpur/concerned Court below in connection with Sessions Trial No. 581 of 2025 arising out of Minapur P.S. Case No. 84 of 2025.

8. As a condition of this order, the Court below before accepting the bail bonds of the petitioner, will verify the fact regarding where the children of the petitioner are staying. It is made clear that the bail bonds of the petitioner shall only be accepted if the children are staying with the family of the petitioner.

9. As a condition of this order, the petitioner is also directed to co-operate in the trial either by appearing personally or through his lawyer on the dates fixed in the trial. Noncompliance of the condition, shall result in cancellation of bail bonds of the petitioner.
