ANJANA MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.06.2019 in connection with Sadar P.S. Case No.396 of 2019 registered for the offence under Sections 420, 419, 467 and 468 of the Indian Penal Code.
Learned counsel for the petitioner submits that only on suspicion, the present petitioner was taken into custody along with other persons and the allegation is that two ATMs cards were recovered from the petitioner. It is further submitted that there is no allegation that the petitioner had attempted to draw any money from any ATM machine using such cards and merely recovery of two ATMs cards does not

Learned counsel for the petitioner further submits that other similarly situated co-accused persons have since been extended the privilege of bail in Cr.Misc. No.55304 of 2019 vide order dated 05.09.2019, Cr.Misc. No.56440 of 2019 vide order dated 09.09.2019 and Cr.Misc. No.60306 of 2019 vide order dated 26.09.2019 and the petitioner's case is also identical.
Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S.
