The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
As per the prosecution case, the allegation against this petitioner is that he assaulted Abdul Rahman on his head by Farsa.
It is submitted on behalf of petitioner that due to previous enmity, simple Maarpit took place between the parties. There is case and counter case. The injury, caused by this petitioner, has been found to be simple in nature. Petitioner claims clean antecedent.
Learned A.P.P. for the State has opposed the bail
Patna High Court CR. MISC. No.305 of 2022(2) dt.21-07-2022 2/2 petition and submitted that there is specific and direct allegation against this petitioner of causing assault by Farsa. However, considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Rautara P.S. Case No. 103 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
