JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Bihta P.S. Case No. 596 of 2018, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 307, 379 of the Indian Penal Code and subsequently under Section 302 of the Indian Penal Code added by Investigating Officer in this case.

Allegation against the petitioner and other co-accused persons that they have assaulted the brother of the informant causing injury to him and while going to hospital, the informant disclosed the name of the petitioner as one of the assailant. Submission of learned counsel for the petitioner is that there is no specific allegation has been attributed against the petitioner and he has no criminal antecedent. Having heard both sides, considering the above submission and also considering that one of the co-accused has granted privilege of anticipatory bail, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Danapur, District Patna, in connection with Bihta P.S. Case No. 596 of 2018 , subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
