The petitioner seeks regular bail in connection with Mahila P.S. Case No. 26 of 2013 for the offence registered under Sections 376(C) and 120(B) of the Indian Penal Code and Sections 4,6,8,10,17,18,41 of the Prevention of Children Act and Section 3(2), 3 (1) (XI) of the SC/ST Act. Informant Kiran Kumari @ Soni made allegation that Mamta Devi asked her to talk with Indrajit and she also asked her to sleep with him at night, who was to marry with her. She further alleged that Mamta Devi asked the petitioner to say

Learned counsel for the petitioner submits that Mamta Devi has already been granted bail by this case for the same occurrence. Three cases were registered and in two cases bearing Mahila P.S. Case No. 26 of 2013 and Mahila Case No. 27 of 2013, Mamta Devi has already been enlarged on bail. The case of the petitioner stands on similar footing. The informant Kiran Kumari @ Soni made specific allegation against Mamta Devi and she further alleged that Mamta Devi asked Rekha to say informant to have talk with the boy, intending to marry with the informant.

Considering the aforesaid facts and circumstances of the case, petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge Pocso, Muzuffarpur in connection with Mahila P.S. Case No. 26 of 2013.
