JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

Heard learned counsel for the petitioners.

It has been submitted on behalf of the petitioners that petitioners sold the land which was earlier recorded in the name of father of accused nos. 6 and 7 and now informant claims the land in question of his possession.

Heard learned A.P.P. as well as informant. Learned counsel for the informant has opposed the prayer for anticipatory bail and submitted that earlier a Title Suit no. 698 of 1960 was decided in favour of the informant on the basis of compromise and

Considering the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners, the same is rejected.

However, petitioners are directed to surrender in the court below, i.e., learned C.J.M., Katihar, in connection with Barsoi P. S. Case no. 224 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.

Accordingly, this application is dismissed.
