2. The petitioner seeks bail in Buxar (Industrial Area) P.S. Case No. 165 of 2023 registered for the offence punishable under Sections-341, 323, 307, 354(A), 504, 506/34 of the Indian Penal Code.
3. As per allegation, in the backdrop of land dispute, the occurrence took place and consequently, the accused persons are said to have assaulted the informant and his family members, as a result of which, they sustained injury.
4. It has been submitted on behalf of the petitioner that there was a free fight between the parties. There is case and counter case between the parties. The other accused persons
Patna High Court CR. MISC. No.67690 of 2024(2) dt.20-09-2024 2/2 have been granted bail by this court by order dated 19-10-2023 passed in Cr. Misc. No. 67700 of 2023. The members of defence side have also suffered grievous injury. The petitioner is a man of clean antecedent and he is under incarceration since 15-072024.
5. Learned APP has opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Industrial Area) P.S. Case No. 165 of 2023 with condition that the petitioner shall cooperated with the trial of the case and make himself available as and when required by the court.
