JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-01-2016 In absence of any statutory law, rules or provision which creates a right in favour of the petitioner and an obligation upon the State Government to take over a privately managed and set up Ayurvedic college, the order of rejection passed by the Principal Secretary, Health, Government of Bihar dated 01.08.2013 contained in Annexure-7 which is under challenge in the writ application is not required to be interfered with.

The Principal Secretary has rightly held that in absence of any law and rules or a policy, the State has no obligation to take over the institution of the petitioner. The said decision is also supported in the counter affidavit of the State. Writ application,
