JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 This application, for grant of anticipatory bail, arises out of Deo P.S. Case No. 43 of 2016, disclosing offences under Sections 420, 406, 409/34 of the Indian Penal Code. Petitioner happens to be Incharge Headmaster of Government Middle School and allegation against him is of misappropriation of Rs. 2,55,000/-, which was meant for construction of school rooms.

Submission of learned counsel for the petitioners that he has falsely been implicated in this case, which will appear from the fact that concerned Block Education Officer has given a certificate (Annexure-3) showing that the petitioner has completed the work and money has been adjusted against the work done.

Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Six Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Deo P.S. Case No. 43 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that he will cooperate in investigation of the case and will appear as and when required by the police, except on showing genuine reasons.
