JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-05-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Dhamdaha P.S. Case No. 158 of 2016 registered under Sections 341, 323, 324, 307, 379, 504 and 506 of the I.P.C. pending in the Court of J.M., 1st Class, Purnea. Submission is that petitioner has clean antecedent and he is innocent. He has falsely been implicated in this due to land dispute.

Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner with submission that there is specific allegation of assault through Dabia on the head of the husband of the informant with intention to kill him.

Patna High Court Cr.Misc. No.8407 of 2017 (3) dt.04-05-2017 2/2 Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
