2. The petitioner apprehends her arrest for the alleged offences under Sections 420, 467, 468, 471, 406 and 34 of the Indian Penal Code registered in connection with Mirganj P.S.Case No. 253 of 2013.
3. It is submitted that the dispute between the parties relating to the JCB machine purchased by the petitioner has since been settled in terms of order dated 23.06.2015 passed by the 1st Additional Sessions Judge, Gopalganj in Criminal Revision No. 1136 of 2014, pursuant to which the JCB machine has since been released to the informant.
4. Despite valid service of notice, none has entered appearance on behalf of the OP No. 2 nor is he represented when the matter is called today.
5. Having regard to the entirety of the facts and circumstances of the case, the provisional anticipatory bail granted
Patna High Court Cr.Misc. No.27423 of 2015 (5) dt.14-09-2016 to the petitioner by order dated 23.07.2015 by this Court in connection with Mirganj P.S. Case No. 253 of 2013 pending in the Court of learned Chief Judicial Magistrate, Gopalganj is hereby confirmed subject to the following conditions - (i) That the petitioner shall not indulge in any similar offence till conclusion of the trial.
(ii) That the petitioner shall cooperate with the investigation and make herself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
(iii) That the petitioner will be well represented on each and every date and if she fails to do so on two consecutive dates without sufficient reason, her bail bond will be liable to be cancelled by the Court concerned.
