The petitioner apprehends his arrest in connection with Kotwa P.S. Case No. 230 of 2022 registered under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that no opportunity was given to petitioner before institution of the present case. Further submission is that several persons having similar allegations in different police stations have already been granted bail by different Benches of this Court vide orders dated 02.02.2018, 25.08.2020 and 12.06.2020 passed in Cr. Misc. Nos. 6039 of 2018, 20276 of 2020 and 60573 of 2019 respectively, as contained in Annexure-2(series) to the bail petition.

No.60529 of 2022(3) dt.21-02-2023 2/2 Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Motihari, East Champaran in connection with Kotwa P.S. Case No. 230 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C. subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
