The petitioner apprehends his arrest in Complaint Case No. 338(C)/2016, registered for the offences punishable under Sections 406, 420, 409 and 120B of the Indian Penal Code. The complainant alleged that the petitioner happens to be the friend of her husband and persuaded her to deposit Rs. 1100/- per month in an account. The complainant deposited the same. It is further alleged that the complainant deposited Rs. 5000/- in the name of her husband, but thereafter the petitioner did not give any paper. During the enquiry it transpired that the company is fake one.

Patna High Court Cr.Misc. No.1224 of 2017 (2) dt.16-01-2017 2/2 Learned counsel for the petitioner submits that the petitioner did not receive any money from the complainant or her husband. Husband of the complainant is L.I.C. agent who asked the petitioner to invest and when the petitioner refused, he got this case filed by his wife. It is further submitted that no chit of paper is filed showing receiving of any amount by the petitioner. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Sheikhpura in connection with Complaint Case No. 338(C)/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
