JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-01-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 25 (I-B)A, 26 and 27 of the Arms Act.

Petitioner was caught with country made pistol and two live cartridges on 22.8.2018 but the petitioner was remanded on 2.9.2018. It is submitted that, as a matter of fact, the petitioner had some dispute with his agnates who badly assaulted the petitioner and handed over to police and subsequently, police being in collusion with agnates of the petitioner, got implicated the petitioner in this false case.

No doubt, petitioner does have criminal antecedent but considering the facts and circumstances as well as submissions

Patna High Court Cr.Misc. No.78624 of 2018(2) dt.18-01-2019 2/2 of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Gogri P.S. Case no. 284/2018.
