The petitioners apprehend their arrest in Banka P.S. Case No.942 of 2016 for the offences punishable under Sections 304B/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioners that the petitioners are the father-in-law and mother-in-law of the deceased and no specific allegation has been alleged against them. It has further been submitted that the deceased was living at Itawa (U.P.) and as such there is no occasion for the petitioners to torture and harass her on account of demand of dowry. Heard learned A.P.P. and learned counsel for the informant, who have opposed the prayer for bail.
Patna High Court Cr.Misc. No.6263 of 2017 (2) dt.17-02-2017 Having heard both sides. In view of the facts and circumstances, stated above, let the petitioners surrender in the court below within a period of four weeks and make prayer for regular bail which shall be considered on its own merit considering the fact that they are father-in-law and mother-in-law and there is submission that they are old persons and considering the aforesaid aspect of the matter and also considering the materials available on the record, the learned court below shall dispose of the prayer for bail of the petitioners, on very same day, without being prejudiced by this order.
With the above observation, this application is disposed of.
